2. Who we are
Thryve Memorial is an independent consumer advocate that helps families pre-plan funeral arrangements completely online. We are not a funeral home, insurance company, cemetery, or crematory. We do not sell funeral goods or services directly. Where appropriate, we may refer you to licensed third-party providers, but the final contract and performance of any funeral or related services is between you and that provider.
3. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use our planning services. If you are using the Services on behalf of another adult, you represent that you have the legal authority to do so, including the authority to make funeral planning decisions and share their personal information with us.
4. Consultations and planning services
Our consultations are complimentary and without obligation. During a consultation, a Thryve planning specialist will discuss options, answer questions, and help you document your wishes. Advice provided is educational and planning-oriented; it is not legal, financial, tax, or medical advice. We recommend consulting a licensed attorney or financial advisor for matters requiring professional advice.
5. No guarantee of pricing or availability
Funeral prices, provider availability, and regulatory requirements vary by location and change over time. Any price estimates or provider references we share are for planning purposes only and do not guarantee that a specific provider, product, service, or price will be available at the time of need. Final arrangements and pricing are determined by the funeral provider you select.
6. User accounts and information
You are responsible for maintaining the confidentiality of any account credentials and for the accuracy of the information you provide. Inaccurate or incomplete information may affect the usefulness of your plan. You agree to notify us promptly of any unauthorized access to your account.
7. Payments and refunds
If you choose to purchase any paid product or service from Thryve Memorial, payment terms will be presented clearly at checkout. Refund policies, if any, will be stated with the specific offering. We use third-party payment processors; by making a payment, you agree to their terms and privacy practices as well.
8. Intellectual property
All content on the Thryve Memorial website and Services — including text, graphics, logos, images, software, and planning materials — is owned by or licensed to Thryve Memorial and is protected by copyright, trademark, and other intellectual property laws. You may use the content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works without our written permission.
9. Prohibited conduct
You agree not to use the Services for any unlawful purpose, to impersonate another person, to submit false information, to interfere with the operation of the Services, to scrape or harvest data, or to harass our team or other users. We reserve the right to suspend or terminate access for violations.
10. Limitation of liability
To the fullest extent permitted by law, Thryve Memorial and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total liability for any claim arising from the Services will not exceed the amount you paid to Thryve Memorial for the Services in the twelve months preceding the claim, or one hundred dollars, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Thryve Memorial from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these terms, or your violation of any rights of a third party.
12. Governing law and dispute resolution
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising from these terms or the Services will be resolved in the state or federal courts located in Montgomery County, Ohio. 13. Changes to these terms
We may revise these Terms of Service at any time. The updated version will be posted on this page with a revised effective date. Material changes will be communicated by email or a prominent notice on the website. Your continued use after changes take effect means you accept the updated terms.
